Terms of Service for FlowPic.ai — binding agreement governing your use of the AI creative platform.

1. Introduction and Acceptance of Terms

Welcome to FlowPic.ai ("FlowPic," "we," "our," or "us"), an AI creative platform for generating product photos, ad creatives, thumbnails, landing page visuals, and short-form video concepts.

By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any of these Terms, please do not access or use our service.

These Terms constitute a legally binding agreement. Please read them carefully. They include important provisions including binding arbitration (Section 15), class action waiver (Section 15.3), and limitations on our liability (Section 13).

These Terms incorporate by reference our Privacy Policy, Refund Policy, and Acceptable Use Policy.

2. Eligibility and Age Requirements

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to access or use FlowPic.ai.

By accessing our service, you represent and warrant that:

  • You are at least 18 years old,
  • You have the legal capacity to enter into a binding contract,
  • Your use of the service does not violate any applicable law.

Children's Privacy (COPPA): FlowPic.ai does not knowingly collect personal information from individuals under 13. If we learn that a child under 13 has provided personal information, we will delete it immediately. If you believe a minor has created an account, contact us at support@flowpic.ai.

3. Use of the Service

FlowPic.ai provides users with AI creative tools, prompt workflows, and generation features for commercial visual creation. You agree to:

  • Use the service in accordance with all applicable local, state, national, and international laws and regulations,
  • Comply with these Terms and all incorporated policies,
  • Not engage in any activity that disrupts or interferes with our services.

4. User Accounts and Registration

4.1 Account Creation

To access certain features of the service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration,
  • Maintain and promptly update your account information,
  • Keep your password secure and confidential.

4.2 Account Security

You are solely responsible for all activities that occur under your account. You agree to:

  • Notify us immediately at support@flowpic.ai of any unauthorized access to your account,
  • Not share your login credentials with any third party,
  • Not create multiple accounts to circumvent restrictions, bans, or credit limitations.

4.3 Account Termination by User

You may close your account at any time by contacting support@flowpic.ai. Upon closure, your data will be handled per our Privacy Policy and applicable data retention laws.

5. AI-Generated Content — Ownership and Licensing

5.1 Platform Intellectual Property

All platform components — including but not limited to the FlowPic.ai user interface, prompt templates, generation workflows, algorithms, brand assets, and documentation — are protected by copyright, trademark, and other intellectual property laws. All such rights are owned by FlowPic.ai and its licensors.

5.2 Your Input and Generated Outputs

  • Your Prompts: You retain ownership of the original text prompts you submit to the platform.
  • Generated Outputs (Free Plan): Images, videos, and other AI-generated outputs produced under a free or trial plan are licensed to you for personal, non-commercial use only. Commercial use requires a paid plan.
  • Generated Outputs (Paid Plans): Subscribers on paid plans receive a non-exclusive, worldwide, royalty-free commercial license to use generated outputs in accordance with the specific plan terms at the time of generation.

5.3 Third-Party Model Limitations

FlowPic.ai uses third-party AI models (including Replicate and OpenRouter). Your rights to generated outputs are also subject to the terms and usage policies of the underlying AI model providers. Some models may impose additional restrictions on commercial use, derivatives, or specific content categories. FlowPic.ai makes no warranty that generated outputs are free of third-party IP claims.

5.4 User Content License to FlowPic.ai

By sharing, publishing, or making generated content publicly accessible on or through the FlowPic.ai platform (e.g., via share links, inspiration galleries, or the public showcase), you grant FlowPic.ai a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute such content solely for the purpose of operating and promoting the platform. You may revoke this license by making the content private or deleting it from your account.

AI-generated outputs may inadvertently resemble existing copyrighted works. FlowPic.ai does not guarantee that outputs are original or non-infringing. You are solely responsible for reviewing outputs before commercial use and for any IP-related claims arising from your use.

5.6 AI Model Improvement — Usage Data License

To the extent permitted by applicable law and our Privacy Policy, you grant FlowPic.ai a perpetual, irrevocable, worldwide, royalty-free license to use anonymized and aggregated generation data (including prompts, generation parameters, model performance metrics, and output quality signals) for the sole purpose of:

  • Improving, training, and fine-tuning AI models and platform features,
  • Conducting internal research and development,
  • Generating anonymized benchmarks and analytics.

We will never use your personal prompts or identifiable outputs for AI training without your separate, explicit consent. Raw prompt text linked to your identity is excluded from this license unless you affirmatively opt in.

5.7 Feedback License

If you submit feedback, bug reports, feature requests, or suggestions to FlowPic.ai (via support, surveys, social media, or any other channel), you grant FlowPic.ai a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into the service without compensation or attribution. You waive any moral rights associated with such feedback to the fullest extent permitted by law.

6. Prohibited Activities

You agree not to engage in any of the following activities while using FlowPic.ai:

6.1 Prohibited: Adult, NSFW, and Sexually Explicit Content

FlowPic.ai's AI image and video generation tools may NOT be used to generate, upload, share, or distribute adult, NSFW, pornographic, sexual, or sexually explicit content of any kind. This includes, without limitation:

  • Nudity, partial nudity, or sexually suggestive imagery,
  • Pornographic, obscene, or sexually explicit material,
  • Content marketed, tagged, or described using terms such as "uncensored," "NSFW," "18+," "no filter," or "unfiltered generation,"
  • Any sexual content involving minors, under any circumstances (zero tolerance — reported to law enforcement).

All prompts submitted to our AI image and video generation endpoints are automatically screened by our Content Moderation system (powered by the Creem Moderation API) before processing, and requests that violate this policy are blocked. See our Acceptable Use Policy (Section 3.1) for the complete list of prohibited content categories.

Content Violations:

  • Generating, uploading, or distributing NSFW, sexually explicit, pornographic, or obscene content
  • Generating deepfake content impersonating real individuals without their explicit consent
  • Creating content that depicts violence, abuse, exploitation of minors, or terrorism
  • Generating content that infringes the intellectual property rights of third parties
  • Creating content intended for harassment, defamation, or targeted abuse of individuals

Platform Abuse:

  • Attempting to reverse-engineer, decompile, or extract proprietary workflows, templates, or algorithms
  • Using automated scripts, bots, or scrapers to access the platform without prior written consent
  • Circumventing, disabling, or tampering with platform security features, rate limits, or credit systems
  • Creating multiple accounts to obtain free credits, bypass bans, or exploit promotional offers
  • Reselling or redistributing access to FlowPic.ai features without explicit written authorization

Legal Violations:

  • Using the service for any illegal purpose under applicable law
  • Using outputs to violate consumer protection, advertising standards, or anti-spam laws
  • Generating content that violates GDPR, CCPA, or applicable privacy regulations

Competitive and Commercial Misuse:

  • Using the service to benchmark, evaluate, or reverse-engineer FlowPic.ai's capabilities for the benefit of a competing product or service
  • Accessing the platform as an employee, contractor, or agent of a direct competitor for the purpose of competitive intelligence gathering
  • Systematically collecting platform data, workflows, prompt templates, or UI patterns to train, evaluate, or build competing AI tools

7. Third-Party Services

FlowPic.ai integrates the following third-party services, each governed by their own terms and privacy policies:

FlowPic.ai is not responsible for the content, policies, or practices of any third-party services. Your use of such third-party services is at your own risk and subject to their respective terms.

FlowPic.ai respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

8.1 DMCA Takedown Requests

If you believe content on FlowPic.ai infringes your copyright, submit a written notice to:

Your notice must include:

  1. Your name, address, and contact information,
  2. Identification of the copyrighted work claimed to be infringed,
  3. Identification of the allegedly infringing content (URL),
  4. A statement of good faith belief,
  5. A statement of accuracy under penalty of perjury,
  6. Your electronic or physical signature.

8.2 Counter-Notification

If you believe content was removed in error, you may submit a counter-notification with the required statutory information. Repeat infringers will have their accounts terminated.

9. Privacy and Data Collection

FlowPic.ai collects account information, usage data, device information, cookies, and payment data. For full details, please refer to our Privacy Policy.

GDPR and CCPA Rights: Depending on your jurisdiction, you may have rights to access, correct, delete, or port your personal data. To exercise these rights, contact support@flowpic.ai.

10. Pricing, Credits, and Payments

  • All pricing is listed in USD unless otherwise stated.
  • Credit packages and subscription plans are governed by our Refund Policy.
  • By default, purchases are final and non-refundable, except as described in the Refund Policy.
  • Subscription plans automatically renew unless cancelled before the renewal date.
  • We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.
  • The Refund Policy governs all refund eligibility, dispute resolution, and chargeback procedures and is incorporated by reference.

10A. Electronic Contract Formation (UETA / E-SIGN Compliance)

These Terms constitute an electronic contract formed under the Uniform Electronic Transactions Act (UETA) and the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq.

  • Electronic Acceptance: By clicking "Sign Up," "Create Account," "Subscribe," "Purchase," or "Generate," or by otherwise accessing and using the service, you electronically accept these Terms and form a binding legal agreement.
  • Record Retention: You consent to receiving all notices, disclosures, and agreements in electronic form. You may request a paper copy by contacting support@flowpic.ai.
  • System Requirements: To access electronic communications, you need a device with internet access and a current web browser. You are responsible for maintaining compatible systems.

11. Service Availability and Modifications

  • FlowPic.ai is provided on a commercially reasonable efforts basis. We do not guarantee uninterrupted or error-free service.
  • Planned Maintenance: We will endeavor to provide advance notice for scheduled downtime exceeding 2 hours.
  • Unplanned Outages: Credit restoration and compensation for platform-caused failures are handled per our Refund Policy (Section 5).
  • We reserve the right to modify, suspend, or discontinue any feature of the service at any time. We will provide reasonable notice for material changes affecting paid subscribers.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We make no warranties regarding:

  • The accuracy, completeness, or originality of AI-generated outputs,
  • That outputs will be free from third-party intellectual property claims,
  • That the service will be uninterrupted, secure, or error-free,
  • That generated content will meet your specific creative or commercial requirements.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  1. FlowPic.ai's total aggregate liability for any claims arising from your use of the service shall not exceed the greater of (a) $100 USD or (b) the total amount you paid to FlowPic.ai in the 3 months preceding the claim.

  2. FlowPic.ai shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, or business interruption, even if advised of the possibility of such damages.

  3. These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise).

Some jurisdictions do not allow limitations on implied warranties or incidental damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless FlowPic.ai and its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of or access to the service,
  • Your violation of these Terms,
  • Your violation of any third-party right (including intellectual property or privacy rights),
  • Any content you generate, submit, or distribute through the platform.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15.2 Binding Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY arising from or relating to these Terms or the service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration Location: Delaware or your home state, at your election.
Arbitration Costs: FlowPic.ai pays all AAA filing fees for claims under $10,000.

15.3 Class Action Waiver

YOU AND FLOWPIC.AI EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes must be brought individually.

15.4 Jury Trial Waiver

BOTH PARTIES WAIVE THEIR RIGHT TO A JURY TRIAL for any dispute subject to these Terms.

15.5 Small Claims Court Exception

Either party may bring an individual claim in small claims court if the claim qualifies (typically under $10,000 USD).

15.6 Exclusive Venue for Non-Arbitrable Claims

If arbitration is unenforceable for a particular claim, exclusive jurisdiction and venue shall be the state or federal courts in New Castle County, Delaware. You consent to personal jurisdiction there.

15.7 Limitation Period

Any claim must be brought within 1 year of the event giving rise to the claim, or it is permanently barred.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time.

  • Non-Material Changes: Effective immediately upon posting.
  • Material Changes (affecting arbitration, governing law, liability limits, or user rights): We will provide at least 30 days' advance written notice via email to registered users before the changes take effect.
  • EU Consumers: Material changes that reduce your statutory rights require your explicit consent or provide the right to terminate your account without penalty.

Your continued use of the service after the effective date of changes constitutes acceptance of the revised Terms.

17. Termination

17.1 Termination by FlowPic.ai

We may suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms,
  • Fraudulent, abusive, or illegal activity,
  • Non-payment of fees.

For non-urgent violations, we will attempt to provide notice and a reasonable cure period before termination.

17.2 Effect of Termination

Upon termination:

  • Your right to access the service ceases immediately.
  • Unused credits are forfeited and non-refundable (except as required by the Refund Policy).
  • Provisions that by their nature survive termination shall survive (including Sections 5, 12, 13, 14, 15).

17.3 Termination by You

You may terminate your account at any time by contacting support@flowpic.ai. Termination does not entitle you to refunds except as described in the Refund Policy.

18. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and FlowPic.ai.
  • Severability: If any provision is found unenforceable, it shall be severed, and the remainder continues in full force.
  • No Waiver: Failure to enforce any provision does not constitute a waiver.
  • Assignment: FlowPic.ai may assign these Terms in connection with a merger, acquisition, or asset sale. You may not assign your rights.
  • Force Majeure: FlowPic.ai is not liable for failures caused by circumstances beyond our reasonable control, including natural disasters, government actions, cyberattacks, internet outages, or third-party service failures.
  • Export Controls: You agree to comply with all applicable U.S. and international export control laws, including the Export Administration Regulations (EAR) and regulations administered by the Office of Foreign Assets Control (OFAC). You represent that you are not located in, or a national of, any country subject to a U.S. government embargo, and that you are not listed on any U.S. government list of prohibited or restricted parties.
  • Language: The English version of these Terms controls in case of any conflict with translated versions.
  • Relationship of Parties: Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and FlowPic.ai.
